Terms and conditions of use of the CoE’s website incl. the Knowledge Hub

The website of the European Centre of Excellence for Civilian Crisis Management e.V. (CoE) incl. the CoE Knowledge Hub (hereinafter “website”), its tools and data, information and knowledge (hereinafter “resources”) provided on the website are subject to the following terms and conditions of use. Please note that access of this website constitutes acceptance of these terms and conditions of use.

Content, ownership and use of resources on the website

The website is meant to be a comprehensive pool of resources on civilian crisis management. It is established under the mandate of the CoE to support the exchange of information on as well as the strengthening and development of the civilian crisis management capabilities of the European Union (EU) Member States, with particular regard to the Common Security and Defence Policy (CSDP) of the EU, and with a view to its contribution to international peace and security.

Only content of this nature expressly regarding civilian crisis management may be posted.

Resources pooled on the website may have been created by the CoE, or by others. Resources created by the CoE are clearly distinguished by use of the CoE’s logo. All non-CoE resources are clearly attributed to the respective author(s) and/or publisher(s).

You may print, download, and store resources for your own convenience and for your personal, non-commercial use, without any right to resell or redistribute them, subject to the other terms below, and also subject to more specific restrictions that may apply to specific content. Any unauthorized use of resources may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.

You may print, download, and store resources from the media repository for non-commercial use. You may redistribute resources from the media repository stating the copyright and license details for the respective resources.

If, as the author or publisher of a work, you feel your rights have been violated and wish to remedy this, please email office@coe.-civ.eu.

Contribution of resources to the website

The contribution of resources to the website through the upload form is welcomed and encouraged. However, contributors shall be responsible for ensuring that their respective content is accurate, and that their respective content does not infringe on proprietary rights of any third party. Contributors shall promptly inform the CoE if their respective content requires revision or removal due to inaccuracy or infringement on proprietary rights or violate other legal provisions (e.g. telemedia law, data protection law).

The content submitted by contributors is reviewed, but not verified or fact-checked by the CoE. Although the CoE reserves the right to do so, the CoE does not edit contributed or provided content of any type, and the CoE additionally reserves the right to refuse or remove any content that violates these terms and conditions of use.

The contributor shall transfer to CoE all rights of use, ancillary copyrights and other rights required for the use of the information under these terms of use, in particular the right to reproduce, distribute, transmit and process to the extent necessary. The aforementioned rights shall in all cases be transferred without limitation and shall entitle the CoE to publish the information on its website.

In the event of a claim by a third party, the user is obliged to provide CoE immediately, truthfully, and completely in good faith with all information available to him and to submit documents required for an examination of the claims.

User and user information

The user is responsible for the use of the website. The user may use the website for lawful purposes only. The user may not use the website in any manner that could damage, disable, overburden, or impair the CoE’s servers or networks, or interfere with any other party's use and enjoyment of the website. The user agrees not to circumvent, disable or otherwise interfere with security-related features of the website or features that prevent or restrict use or copying of any resources or enforce limitations on use of the website or the resources. The user may not attempt to gain unauthorized access to the CoE’s computer systems or networks, through hacking, password mining or any other means. The CoE reserves the rights to take any legal and technical actions to prevent the violation of this provision and to enforce these terms and conditions of use without prior notice to the user.

In order to access certain parts of the website, the user may have to create a username and complete an account registration process. The user agrees to provide accurate, current, and complete information for the account registration process.

The user is responsible for maintaining the confidentiality of the user’s account password and username. The user will inform the CoE (office@coe-civ.eu) immediately of any  unauthorized use of the user’s password or username or any other breach of security. In the event of misuse, the CoE is entitled to block access to the database until the circumstances have been clarified and the misuse has been stopped. The user shall be liable for any misuse for which he or she is responsible.

The CoE reserves the right, at its sole discretion for any reason or no reason at any time and from time to time and with or without notice to the user, to modify or discontinue, temporarily or permanently, the website (or any part thereof) or to terminate the user’s username and account and/or access to the website (or any part thereof).

To the extent legally permissible,  the CoE shall not be liable for any loss, damage, liability, or expense incurred or suffered which is claimed to result from the user’s use of the website or resources made available on the website, including without limitation, any fault, error, omission, interruption, or delay with respect thereto.

The CoE will only use user data in accordance with the terms of its data privacy policy. The CoE will not sell any personal information about registered users to any third parties. The CoE may use account information generically in order to revise its services or present findings from the use of its services.

The user can request deletion of his or her user account at any time (office@coe-civ.eu). If the user account is deleted, all information contained therein will be irrevocably deleted. Content the user has uploaded for publication will not be deleted.

Links and endorsement

We are responsible for the contents of our website in accordance with the general laws, in particular in accordance with § 7 paragraph 1 of the German Telemedia Act. All contents are created with due care and to the best of our knowledge. As far as we refer to third party websites via links on our website, these links are provided for the convenience as a courtesy only and do not mean and do not imply the endorsement of the linked websites by the CoE. The user acknowledges and agrees that the CoE is not responsible or liable for access to or the content or accuracy of these other websites. No guarantee is given for their completeness and correctness. The CoE has no influence whatsoever on the current and future design and content of external websites linked to our website. If you feel that a particular resource on the website is misleading or abusive, please email office@coe-civ.eu.

Indemnification

While the CoE undertakes reasonable measures to ensure the accuracy of all information posted on the website, the resources contained on this website could include inaccuracies or other errors. Use and browsing of this website is at the user’s own risk. The CoE does not warrant that the functional aspects of this website will be uninterrupted or error free or that this website or the server that makes it available are free of viruses or other harmful components.  

In the event of intent and gross negligence, including that of CoE’s legal representatives, CoE shall be liable in accordance with the statutory provisions. The same shall apply in case of culpably caused damages resulting from death or injury of body or health and in case of maliciously concealed defects. In case of damage to property and financial loss caused by slight negligence of CoE or our legal representatives, liability shall be limited in each case to cases of breach of an essential obligation. Essential obligations are those whose fulfilment make the proper performance possible in the first place and on whose compliance the contracting parties may regularly rely. The amount shall be limited to the damage foreseeable and typical. In all other respects our liability is excluded.

Notwithstanding the foregoing, CoE shall not be liable, except in the case of intent and gross negligence, for loss of data insofar as this results from the fact that recovery is not possible or is made more difficult due to a lack of or insufficient data backup.

CoE shall also not be liable for the correctness, completeness and timeliness of the information published.

The legal information on this site as well as all questions and disputes in connection with the design of this website are subject to the laws of the Federal Republic of Germany.
